Terms of Service
Effective Date: September 23, 2026
1. Acceptance of these terms
By using the Parm Rx Express website (the “Site”), you agree to these Terms of Service. If you do not agree to them, please do not use the Site. You are always welcome to call us at (718) 627-7070 or come into the pharmacy instead.
These Terms are an agreement between you and Parm Rx Express (“we”, “us”), a pharmacy registered with the New York State Education Department, located at 1311 Gravesend Neck Road, Brooklyn, NY 11229.
2. What this website is, and what it is not
Please read this section. It is short, and it prevents most misunderstandings.
- You cannot buy prescription medication on this Site. We do not sell or dispense prescription medication online, and there is no way to upload a prescription here.
- The shop sells over-the-counter items only: non-prescription remedies, vitamins, supplements, and everyday health products.
- The transfer form is a request for a phone call, not a prescription order. See section 4.
- The shop is a catalog, not an online checkout. You can see what we stock and what it costs; to order, call us or come into the pharmacy. There are no accounts or logins on this Site.
- The Site is not medical advice. See section 9.
3. Who may use the Site
To order from us or send us a request, you must:
- Be at least 18 years of age. A parent or guardian may order or send a request on behalf of someone under 18.
- Be ordering for delivery within our local delivery zone (see section 7), or for pickup in the store. We deliver locally. We do not mail or ship orders across state lines.
- Give us information that is accurate, so that we can actually reach you, and keep it up to date.
4. Prescription transfer requests
The transfer form asks for your name, your phone number, and the pharmacy you are leaving. It does not ask for your medications, and you should not type them in. A licensed pharmacist will call you, take the details, and contact your old pharmacy.
Submitting the form starts a conversation, it does not move anything by itself. A transfer is complete only once our pharmacist has spoken with you, obtained the prescription from your previous pharmacy, and verified it. We may decline a transfer at our professional discretion. Some prescriptions, including certain controlled substances, can be transferred only once or only in limited situations, and some cannot be transferred. Our pharmacist will tell you on the call.
If the form cannot be sent for any reason, the Site tells you so and asks you to call. Nothing is sent silently.
If you need a medication urgently, call us at (718) 627-7070 rather than using the form.
4A. Contact form
The contact form is for questions about the pharmacy, deliveries, the shop, or billing. Please do not put medication or health details in it; call us for anything about your medications. We aim to reply within one business day. Where your message goes and how long we keep it is in our Privacy Policy.
5. Over-the-counter products
Items in the shop are non-prescription products. Always read the label and follow it, and speak to a pharmacist or your doctor if you are unsure whether a product is right for you, particularly if you take prescription medication.
Supplements and homeopathic products. Vitamins, dietary supplements and homeopathic products in the shop are not medicines. Statements about them have not been evaluated by the Food and Drug Administration, and they are not intended to diagnose, treat, cure or prevent any disease.
Age-checked items. Cough medicines containing dextromethorphan (DXM) and weight-loss or muscle-building supplements can only be sold to adults 18 and over. When we deliver them, the driver checks a photo ID at the door and cannot hand them to anyone under 18 or leave them if no one is home. We do not sell tobacco, vaping or nicotine products online or for delivery.
Pseudoephedrine (Sudafed and similar). Federal law requires us to check your photo ID and record the sale in a logbook at the counter, so these products are in-store pickup only. We do not deliver them.
Freshness and recalls. We do not deliver items that are close to their expiration date. If a product we sold you is recalled, we call you if we have your number, and we refund or replace it, even if it is opened.
Availability and prices. We do our best to keep prices and availability correct, but errors happen and stock runs out. If an item you ordered turns out to be unavailable, we contact you and remove it from the order; if you have already paid for it, we refund that item. If an item was listed at the wrong price, we contact you, and we may cancel that item. You are not charged for an item we cancel. We may limit quantities per household for safety.
5A. How an order becomes an order
When you order by phone, we check your address against the delivery zone and your order against the minimum before we accept the order. We accept it when we tell you on the call that it will go out and on which day. An order outside the zone is declined before anyone is charged. We never substitute a different product, brand or size without your agreement on the phone.
6. Prices, sales tax and payment
Prices on the Site are in U.S. dollars and do not include New York sales tax. The price we charge is the price we tell you on the phone, not any different price shown elsewhere, including on the shelf.
In New York, medicines (prescription and over-the-counter), vitamins and dietary supplements, medical supplies like bandages and thermometers, diapers, and feminine hygiene products are exempt from sales tax. Cosmetics and toiletries (toothpaste, mouthwash, deodorant, ordinary shampoo and soap) and other general items are taxable. The combined sales tax rate in Brooklyn is 8.875%.
This Site does not take payment. You order by phone or in the pharmacy. The pharmacy tells you on the call how payment is taken: by card when the order is delivered, or in the store when you pick up. There is no charge for paying by card. If payment is not made at the door, the order comes back to the pharmacy and is cancelled. There is no delivery fee (see section 7).
Offers and coupons. Any discount or offer we run applies only to items you pay for yourself. It cannot be used on anything paid for in whole or in part by Medicare, Medicaid or any other government health program, and it is never a reward for transferring or filling a prescription. Offers cannot be exchanged for cash.
7. Delivery
We deliver over-the-counter orders to addresses within about 3 miles of the pharmacy. The Site sets this zone by ZIP code. We deliver to addresses in these ZIP codes:
- 11204 (Bensonhurst / Mapleton)
- 11210 (Flatlands / Midwood)
- 11214 (Bath Beach / Bensonhurst)
- 11223 (Gravesend)
- 11224 (Coney Island)
- 11229 (Homecrest / Sheepshead Bay)
- 11230 (Midwood)
- 11234 (Marine Park)
- 11235 (Sheepshead Bay / Brighton Beach)
You can also check your ZIP code on the delivery page. Zone edges. We use ZIP codes as a quick check. A few streets at the far ends of 11234 and 11224 are more than 3 miles from the pharmacy; if your address is one of them we tell you before you pay, and we may still deliver by arrangement. If your ZIP code is not on this list, call us; we will tell you whether we can deliver to you before anyone is charged.
- Minimum order: $25, counted before tax.
- Delivery fee: none. Delivery is free on orders of $25 or more.
- Delivery days: Monday, Tuesday, Thursday and Friday.
- Same-day delivery: an order placed before 2:00 PM (New York time) on a delivery day goes out for delivery that same day. An order placed later goes out on the next delivery day.
- Holidays and weather: there is no delivery on days the pharmacy is closed, and we tell you so when you order. Severe weather, a blackout, or a public emergency can stop deliveries for a day. We call you if your order is affected.
When you order by phone, we check your address against the delivery zone and your order against the minimum before we accept the order.
We do not promise a time of day, and delivery times are our best estimate. We do not ship to other states, we do not mail prescription medication, and we do not use a courier network. Deliveries are made by the pharmacy.
If we cannot deliver when we said. If your order will not go out on the day we told you, we call you before then with the new day. You can wait, or cancel for a full refund of anything you paid. If you paid and we cancel, we refund within 7 business days (one billing cycle for cards).
At the door. Our driver hands the order to you or to an adult at your address. We do not leave orders in a hallway, with a doorman, or outside a door unless you have asked us to (when you ordered by phone) and we agree it is safe. If we leave an order where you asked, it is in your care from that moment, and we cannot replace an order that goes missing after that. We do not leave orders outside in heat or freezing weather. Age-checked items (section 5) are handed only to an adult with photo ID and are never left.
Nobody home. The driver calls the phone number you gave us. If we cannot reach you, we bring the order back to the pharmacy and try again on the next delivery day at no charge, or you can collect it in the store. If two delivery attempts fail, we cancel the order and refund anything you paid.
Responsibility for the items passes to you when they are handed over or left where you asked. Please check the bag at the door; if anything is missing or damaged, tell the driver or call us that day.
Pickup. You can order by phone and collect in the store instead. We tell you when you order how long we hold a pickup order. Bring your name or order number, and photo ID for age-checked items. After that time we put the items back on the shelf and refund anything you paid.
Prescription delivery. This section covers over-the-counter orders. Delivery of your prescriptions is a pharmacy service arranged with the pharmacist by phone or in the store; it is governed by our pharmacy policies and New York pharmacy law, and it comes with a written offer to talk with a pharmacist and the number to call.
8. Returns and refunds (over-the-counter items)
If something is wrong with your order, call us at (718) 627-7070 and we will make it right.
All delivery and pickup orders are final once we have accepted them: they cannot be cancelled or returned because you changed your mind. We still refund or replace any item that arrives damaged, expired, recalled, or that is not what you ordered. Tell us within 30 days. If we cannot supply an item, we remove it and do not charge you, or refund it if you were charged. Opened medication and opened health products are never taken back.
- Opened medication and opened health products cannot be returned, for the safety of every other customer. This is standard practice for pharmacies and it is not negotiable.
- Sale items follow the same rules.
- Proof of purchase. Bring or tell us your receipt or order number; we can look up phone and delivery orders by your name.
- Timing. Approved refunds go back the way you paid, within 5 business days; your bank may take a few more days to show it.
- You can ask us for a written copy of this policy at any time.
None of this affects your rights under New York consumer protection law.
9. The Site is not medical advice
Product descriptions and anything else on this Site are general information, not medical advice, diagnosis, or treatment, and they do not create a pharmacist-patient relationship on their own. Always check the package label and talk to your healthcare provider about your health and your medications. Never ignore medical advice, or delay getting it, because of something you read here. If this is an emergency, call 911.
Talking to a pharmacist. A licensed pharmacist is in the store during our opening hours and will answer questions about any medication, prescription or over-the-counter, in person or by phone at (718) 627-7070. That is free. If we deliver a prescription to you, the delivery includes a written offer to counsel with that number on it, as New York law requires. If you would rather not be counseled, you can say so, and we note that in our records.
10. Acceptable use
Please do not attempt to break, overload, scrape, or gain unauthorized access to the Site; do not use it to impersonate someone else or to submit information that is not yours to submit; and do not try to obtain another customer's account or password. Please treat our staff and drivers with respect. We may refuse service to anyone who does not.
11. Intellectual property
Our own text, photographs, logos and the design of this Site belong to Parm Rx Express and are protected by intellectual property law. Product names, packaging images and brand logos belong to their manufacturers and are shown to identify the products we sell. Please do not copy or reuse anything from the Site without written consent from whoever owns it.
12. Disclaimer of warranties
THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. THIS DISCLAIMER APPLIES TO THE WEBSITE. IT DOES NOT LIMIT OUR OBLIGATIONS AS A LICENSED PHARMACY UNDER FEDERAL AND NEW YORK LAW, AND IT DOES NOT APPLY TO THE PRODUCTS WE SELL YOU.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PARM RX EXPRESS, ITS OFFICERS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE.
Nothing in these Terms limits or excludes our liability for fraud, for death or personal injury caused by our negligence, for our professional obligations as a licensed pharmacy, or for any other liability that cannot lawfully be limited. Some jurisdictions do not allow certain limitations, and in those jurisdictions our liability is limited only to the extent the law allows.
14. Indemnification
You agree to indemnify and hold harmless Parm Rx Express and its officers, employees, and agents from claims, liabilities, damages, losses, and reasonable costs arising out of your misuse of the Site, your violation of these Terms, or your violation of someone else's rights.
15. Disputes
If something goes wrong, call us first at (718) 627-7070; most problems are solved in one phone call. If we cannot solve it, any dispute about these Terms, the Site or an order is governed by New York law and may be brought in the state or federal courts in Kings County, New York, including Small Claims Court.
Nothing in these Terms limits any right you have under New York consumer-protection law, or your right to complain to a regulator, including the New York State Education Department's Office of Professional Discipline (which handles complaints about pharmacies; 1-800-442-8106), the New York State Attorney General, or the New York City Department of Consumer and Worker Protection.
16. Governing law
These Terms are governed by the laws of the State of New York. Disputes belong in the state or federal courts located in Kings County, New York, including Small Claims Court.
16A. Language
We write these Terms, our Privacy Policy and the Site in English. The Russian link at the top of other pages uses Google's automatic translation, which nobody at the pharmacy has checked; it is for convenience only and may contain errors. If anything is unclear, call us: we speak English and Russian. The languages we serve in are described on our Nondiscrimination and languages page.
16B. Electronic communications and email
If you join our mailing list, we send occasional pharmacy news and offers by email, in the language you pick. Every email tells you how to unsubscribe and carries our street address. We stop sending within 10 business days of your request, usually the same day.
16E. Accessibility
We want everyone to be able to use this Site. Our Accessibility Statement explains what we have done and how to tell us about a problem. You can always order, ask a question or transfer a prescription by phone at (718) 627-7070.
16F. Third-party services
The Russian link on most pages uses Google Translate. Their pages and services are governed by their own terms, and we do not control them. Links to other websites are for convenience; their rules apply once you are there.
17. Changes to these Terms
We may change these Terms. Each version carries its effective date at the top, and we keep every past version; ask us for one at any time. A change that affects your rights or what you pay applies only to orders placed after we have told you about it. Continuing to browse the Site does not, by itself, mean you have accepted a material change. If a change is significant, we say so plainly rather than quietly swapping the page.
18. Miscellaneous
We may change, suspend or withdraw any part of the Site, including the shop, at any time; the pharmacy stays open. If any provision of these Terms turns out to be unenforceable, the rest stays in force. Our not enforcing something once does not waive it. These Terms, together with our Privacy Policy, are the agreement between us regarding the Site. If the pharmacy is ever sold, these Terms go with it and we will tell you. Sections 12 to 16 keep applying after you stop using the Site.
